Welcome to Noti. These Terms of Service (“Terms”) govern your access to and use of the Noti mobile application, website, and related services (collectively, the “Service”). By downloading, accessing, creating an account for, or using Noti, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. About Noti

Noti is a notification platform designed to help organizations, businesses, schools, churches, teams, and other groups communicate with their members through push notifications and related messaging features. Noti provides tools for creating, managing, and distributing notifications but is not responsible for the content submitted by organizations.

2. Eligibility

You must be at least 13 years of age, or the minimum age required by the laws of your jurisdiction, to use the Service. If you are under the age of majority, you represent that you have permission from a parent or legal guardian to use Noti.

Organizations creating administrator accounts represent that they have the authority to act on behalf of their organization.

3. User Accounts

Certain features require an account.

Notify us immediately if you suspect unauthorized access.

4. Organization Accounts

Obtaining any required permissions before sending notifications.

Content distributed through the Service.

Noti does not verify the accuracy of organization announcements.

5. Acceptable Use

You agree not to use the Service to:

Harass, threaten, or abuse others.

Impersonate another individual or organization.

Send spam or unsolicited communications.

Distribute malware, viruses, or harmful software.

Interfere with the operation of the Service.

We do not guarantee that every notification will be delivered or received immediately.

7. User Content

Organizations and users retain ownership of content they submit.

By submitting content, you grant Noti a worldwide, non-exclusive, royalty-free license to store, process, display, transmit, and distribute that content solely for operating and improving the Service.

You represent that you have the rights necessary to submit such content.

8. Intellectual Property

The Service, including its software, branding, logos, interface, graphics, source code, documentation, and other materials, are owned by Noti or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works without prior written permission.

9. Privacy

Your use of Noti is also governed by our Privacy Policy.

By using the Service, you acknowledge that your information may be collected, processed, stored, and used as described in the Privacy Policy.

10. Third-Party Services

Noti is not responsible for third-party services.

We strive to provide reliable service but cannot guarantee uninterrupted availability. If possible, we will alert you a week, 3 days, and the day before we aren't available.

The Service may occasionally be unavailable due to:

Third-party service interruptions

12. Updates

We may modify, improve, suspend, or discontinue features at any time without prior notice.

We do not guarantee that:

Notifications will always be delivered.

The Service will be error-free.

Bugs will be corrected immediately.

The Service will meet every user’s expectations.

20. Limitation of Liability

To the fullest extent permitted by law, Noti, its owners, employees, contractors, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Service.

Our total liability shall not exceed the amount you paid to use the Service during the twelve months preceding the claim, or USD $100 if no payments were made.

21. Indemnification

You agree to defend, indemnify, and hold harmless Noti and its affiliates from claims, damages, liabilities, costs, and expenses arising from:

Your use of the Service.

Your content.

Your violation of these Terms.

Your violation of applicable law.

Your infringement of another person’s rights.

22. Governing Law

These Terms shall be governed by and interpreted under the laws of the jurisdiction in which the Service operator resides, without regard to conflict of law principles.

23. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall continue in full force and effect.

24. Waiver

Failure to enforce any provision shall not constitute a waiver of that provision or any other rights.

25. Entire Agreement

These Terms constitute the entire agreement between you and Noti regarding the Service and supersede any previous agreements or understandings.

When material changes are made, we will revise the “Last Updated” date and may notify users through the application or by other appropriate means.

Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
